Drug Trials Ending in Probation

After two trials, both of which resulted in hung juries, the defendant was offered, and accepted, a sentence of probation, even though he was caught with more than 402 kilos of cocaine, while unloading boxes from a truck at his place of business.  At both the first and second trials, the jury accepted the defendant’s testimony that he did not know what was in the boxes, although, when questioned, he stated: “I knew it was not cheese.”  At the time, the defendant was in his 20’s and was a world champion go-cart racer.
