The defendant was charged with involvement in an illegal drug conspiracy with a doctor, based on filling facial valid prescriptions for oxycodone and other narcotics. After a lengthy motion to suppress, the Court granted the defendant’s motion that the Affidavit in support of the motion was insufficient to find probable cause, even though the Affidavit was 92 pages in length, and contained the expert’s opinion of the defendant’s alleged illegal actions. The government, thereafter, offered the defendant a probationary sentence.
